Why there is no one-line answer
Under the Constitution, betting and gambling is a state subject. That is why the map is uneven. The old central law, the Public Gambling Act of 1867, was written for physical gaming houses and says nothing about the internet. States then made their own rules on top of it. Some, including Telangana, Andhra Pradesh and Tamil Nadu, have passed laws that specifically restrict online gaming for money. Others, such as Sikkim and Nagaland, run licensing systems for certain games. Many states have not updated their law at all.
What changed in 2025
In August 2025 Parliament passed the Promotion and Regulation of Online Gaming Act. In broad terms it separates e-sports and social games, which it supports, from online money games, which it restricts at the national level, including how they may be offered, advertised and paid for. The detailed rules, enforcement and court challenges are still developing, and the position may have moved since this page was last updated. If you read an article about Indian gaming law written before mid-2025, treat it as out of date.
What this means for you in practice
- Check your own state first. If your state prohibits online gaming for money, that is the end of the matter. Do not play, and do not try to get around it with a VPN.
- Check the current central position. Read a recent, reliable news source or speak to a lawyer if you are unsure. A WhatsApp agent's word, ours included, is not a legal opinion.
- You must be 18 or older. Nothing anywhere changes that.
- Winnings are taxable. Indian income tax law taxes winnings from online games, and tax may be deducted at source. Keep your own records.
